Question by malik g: need help filing a suit agist a automobile insurance company?

first off do i sue the person that hit me while i was walking into a store and i need step by step help so if there is any inspiring lawyers or any good christians that want to help a fellow christ lover please help i have dr,and chiro billsi have injuries to my back, neck, and ive been out of work for a month

Best answer:

Answer by oklatom
Are you now done with treatment, and able to work again? Get a letter from your doctor giving your injuries, dates of treatment, diagnosis and prognosis. Gather all your doctor bills. Get a statement from your employer as to your lost pay for the month. Add the two figures together. Perhaps add a bit on to the total for pain and suffering if you are so inclined.

With that figure in mind, call the insurance company and see if they are willing to settle for that amount in exchange for your release against future claims.

Only if that falls apart do you even have to think about involving attorneys in the mix.

Question by alesia m: Automobile insurance comprehensive claim question. Help!!!!?

I live in Gastonia, NC and have a comprehensive insurance claim in process. The value of the car is 11,650.00 and the estimate on the claim is 8,705.49. What are my options and rights? The damage is very close to being 75% of the value of the car. I am not out to take advantage of anyone, but I work hard for what I have and I want to be absolutely sure I am not cheating myself. Can someone with experience with this situation, the laws or work in the field please help me? Your help is much appreciated.

Best answer:

Answer by tonevault
If the car is not “totalled,” then you can get a few estimates for the repair….They will give you an average.

If the car is totalled, then you need to show them evidence that it is worth more than their estimate. Their job is to pay as little as they can, your job is to show that the car is worth more.

What do you think? Answer below!

Question by norm g: Is there a consumer advocate for automobile extended warranty insurance?I think I was ripped off.?

I am stranded 367 miles from home.My car engine failed with 92,000miles on it . The extended warranty insurance was SUPPOSED to cover the car to 108,000 miles but they denied my claim.I’m out 00 for the policy, and am looking at,at least ,several thousand more to replace the engine. They are claiming that the RADIATOR failed, causing my engine to overheat and fail. And the radiator is not covered-so any resulting DAMAGE is not covered. Getting this policy seems to have been a waste of money.Continental Warranty is the insurer.Any help with this would be greatly appreciated. Thanks!

Best answer:

Answer by mbrcatz17
Well, if you read the contract carefully, you’lll probably find out that the extended warranty is actually NOT an insurance policy.

And I don’t know of any consumer advocate to help out with this, especially if the coverage states resulting additional damage isn’t covered. You might want to check with www.troubleshooter.com and see if Tom Martino has any suggestions.

Question by Kathryn P: Texas Automobile Insurance?

I got hit by someone else. Their insurance is not providing total cost up front for a rental car while mine is in the shop. I was not at fault. The Insurance carrier is Farmer’s Insurance. They said to pay the difference of the rental, and they would reimburse.

My understanding by an insurance facilitator at my old company is that if the fault was not yours, then the insurance company has to accommodate you with full pay for the rental car for a comperable vehicle to the one that was damaged.

Anyone have any knowledge of the law, and links where I can find out the info?

Thank you in advance.

Best answer:

Answer by oklatom
No, what they told you is correct. What they are doing is allowing the allowance you have on your policy for the rental car, which apparently is less than the charge. So, you pay the difference, submit the bill for that and as they said, they will collect from the at fault person and reimburse you.

They do compensate, but in your case you will get part of after the fact instead of before. Most standard policies are written that you will be reimbursed for covered out of pocket claims at the end of things, not the beginning. Check with your agent, or read the spidery print on your policy.

What do you think? Answer below!
